12/10 MINUTES - PLANNING AND DEVELOPMENT COMMITTEE - 22 JUNE 2012

The Minutes of the meeting of the Planning and Development Committee held on 22 June 2012 were taken as read and approved as a true record.

12/11 SCHEDULE OF THE REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1990 and the Head of Development Control reported thereon.

 

SUSPENSION OF COUNCIL PROCEDURE RULE NO.10 - ORDER OF BUSINESS

 

ORDERED that, in accordance with Council Procedure Rule No. 10, the Committee agreed to vary the order of business.

 

ORDERED that the following applications be determined as shown:

 

M/FP/0446/12/P - Part two-storey, part single-storey extension to rear of 162 Marton Road, Middlesbrough for Mr G Mohammed.

 

Deferred pending a site visit.

 

M/FP/0574/12/P - Change of use from hairdressers (A1) to cafe (A3) at 6 York Road, Middlesbrough for Mr F Livingstone.

 

Deferred pending a site visit.
 

**DECLARATION OF INTEREST - Councillor J Hobson declared non-pecuniary interest in the following application on the grounds that he was a member of "The Friends of Longridge Wood" organisation.

 

M/FP/0367/12/P - Erection of 79 no. dwellings with associated access and landscaping at Site 44 (Longridge), land between Shandon Park/Rushmere/Stainton Way for Gentoo Homes Limited

 

The Head of Development advised Members that this application had been identified as requiring a site visit by Members of the Planning and Development Committee.  Accordingly a site visit had been held prior to the meeting on 20 July 2012.

 

Full details of the planning application, plan status and planning history were outlined in the report.  The report contained a detailed analysis of the application and analysed relevant Policies from the National Planning Policy Framework (NPPF) and the Middlesbrough Local Development Framework (LDF).

 

Neighbourhood consultations had taken place and twenty six objections were received, the details of which were advised to the Committee.  Comments from the statutory authorities were also included in the report.  The Head of Development addressed the objections and comments received.

 

The applicant was present at the meeting and elected to address the Committee.  Councillor C Hobson, Ward Councillor, addressed the Committee and spoke in opposition to the application.  A number of objectors were present at the meeting and two representatives elected to address the Committee on behalf of the objectors and spoke in opposition to the application.

 

The Legal Adviser referred to two footpaths that existed on the site.  The Rights of Way Officer had recommended that the Council accepted the two routes, under common law, as Rights of Way and divert them via the making of a Definitive Map Modification Order.   Whilst the paths were in place they were not a determinative issue with regard to the planning application.

 

ORDERED that the application be Approved subject to the conditions included in the report for the reasons set out in the report and subject to the signing of a Section 106 agreement.

 

M/FP/0548/12/P - Extensions to roof to create first floor living accommodation with Juliet balcony to rear at 1 Botany Way, Nunthorpe, for Mr D Harris

 

The Head of Development advised Members that this application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held prior to the meeting on 20 July 2012.

 

Full details of the planning application, plan status and planning history were outlined in the report.

 

Neighbourhood consultations had taken place and ten objections were received, the details of which were advised to the Committee.  A written representation had also been received from Councillor Thompson, Ward Councillor, in opposition to the application.  Comments from the statutory authorities were also included in the report.  The Head of Development addressed the objections and comments received.

 

The applicant was present at the meeting and elected to address the Committee.   A number of objectors were present at the meeting and two representatives elected to address the Committee on behalf of the objectors and spoke in opposition to the application.

 

ORDERED that the application be Refused for the following reasons:

 

The proposed extension to roof to create first floor living accommodation with Juliet balcony to rear by reason of its size, location and appearance is out of keeping and not complementary and would have a harmful effect on the character of the host dwelling and wider area.


The proposed extension to roof to create first floor living accommodation with Juliet balcony to rear by reason of size, location, appearance and design is considered unacceptable, as it would be detrimental to the amenity of adjacent occupiers, creating a dominating and visually intrusive feature that would be oppressive.


The proposal constitutes an unacceptable form of development that is contrary to and conflicts with the provisions of Policy CS5 (c) and (f) and Policy DC1 (b) and (c) of the Middlesbrough Local Development Framework.

 

 M/OUT/1111/11/P - Outline residential development comprising 12 no. dwellings and 2 no. apartments on land to the rear of 50-60 Hutton Road, Middlesbrough for Ayresome Developments Limited

 

The Head of Development advised Members that this application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held prior to the meeting on 20 July 2012.

 

Full details of the planning application, plan status and planning history were outlined in the report.

 

Neighbourhood consultations had taken place and seven objections were received, the details of which were advised to the Committee.   Comments from the statutory authorities were also included in the report. The Head of Development addressed the objections and comments received.

 

The applicant's agent was present at the meeting and elected to address the Committee.   An objector elected to address the Committee and spoke in opposition to the application. 
 

ORDERED that the application be Approved subject to the conditions included in the report for the reasons set out in the report.

 

M/FP/0257/12/P - Erection of 1 no. detached dwelling house with detached garage at 68b Southwood, Coulby Newham,  for Mr D Brown

 

The Head of Development advised Members that this application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held prior to the meeting on 20 July 2012.

 

Full details of the planning application, plan status and planning history were outlined in the report.

 

Neighbourhood consultations had taken place and nine objections were received, the details of which were advised to the Committee. Comments from the statutory authorities were also included in the report. The Head of Development addressed the objections and comments received.

 

The applicant was present at the meeting and elected to address the Committee.

M/FP/0420/12/P - Use of land for siting of 1 no. container for domestic storage purposes on land to the rear of 35a-39 Saltersgill Avenue, Middlesbrough for Mr M Finnegan

The applicant's agent was present at the meeting and elected to address the Committee.   Councillor McTigue, Ward Councillor, addressed the Committee and spoke in opposition to the application.


ORDERED that the application be Approved subject to the conditions included in the report for the reasons set out in the report.

12/12 PLANNING APPEAL

The Director of Legal and Democratic Services presented a report, the purpose of which was to advise members of the findings of the Inspectorate appointed by the Secretary of State for Environment, Transport and the Regions, with regard to the following appeal:-

 

Site at 73 Mallowdale, Nunthorpe - (M/FP/1170/11/P) - Appeal dismissed.

 

A copy of the decision notice for the appeal was attached to the report for Members’ information.

 

ORDERED that the report and its contents be noted.

12/13 APPLICATIONS APPROVED BY THE HEAD OF PLANNING AND REGENERATION

The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992).

Acklam Hall

 

The Section 106 Agreement was now complete and awaiting sign off from Middlesbrough College.  The Council was now in a position to issue decision notices, subject to the signing of the Section 106 Agreement.

Sprinkler System

 

The Chair and Councillor Clark had recently received a presentation at a Cleveland Fire Authority meeting in relation to a life-saving sprinkler system which could be installed in domestic properties.  The Building Control Manager gave a brief outline of the system.

 

ORDERED that the Head of Development would arrange a briefing for all Members in relation to the sprinkler system.
