12/20 MINUTES - PLANNING AND DEVELOPMENT COMMITTEE - 13 AUGUST 2012

The Minutes of the meeting of the Planning and Development Committee held on 13 August 2012 were taken as read and approved as a true record, subject to the following amendment:

 

Minute No 12/16 (2)  - delete:

 

"That the Council introduce a compulsory requirement that fire sprinkler systems be installed in any new domestic properties erected on Council land in all future development briefs for residential development."

 

and replace with:

 

"That the Planning and Development Committee recommends that the Executive Sub-Committee for Property considers the inclusion of a requirement for fire sprinkler systems in new domestic properties erected on Council land as part of the land disposal process."
 

 

AGREED

12/21 SCHEDULE OF REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1990 and the Head of Development Control reported thereon.

 

ORDERED that the following applications be determined as shown:

 

M/FP/0697/12/P - Change of use from shop (A1) to (A2) at 45 Acklam Road, Middlesbrough for Mr T Carrigan.

 

The Head of Development advised Members that this application had been identified as requiring a site visit by members of the Planning and Development Committee.  Accordingly a site visit had been held on 17 September 2012.

 

Full details of the planning application, plan status and planning history were outlined in the report.  The report contained a detailed analysis of the application and analysed relevant policies from the Local Development Framework.

 

Neighbourhood consultations had taken place and two representations from local residents in opposition to the application had been received, the details of which were advised to the Committee.  There were no objections from the statutory authorities.

 

The agent was in attendance and elected to address the Committee.  It was highlighted that the application was for a change of use from A1 to A2  for general office use, rather than specifically as a betting office.

 

ORDERED that the application be Approved, subject to the conditions detailed in the report.

 

M/RES/0655/12/P - Reserved matters application for the erection of 10 no self-contained flats with associated car parking. 

 

The Head of Development advised Members that this application had been identified as requiring a site visit by members of the Planning and Development Committee. Accordingly a site visit had been held on 17 September 2012.

 

Full details of the planning application, plan status and planning history were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the Local Development Framework.

 

With regard to the plans, it was highlighted that details of the dormer windows set in the roof had been ommitted in error from the side elevation view.

 

Neighbourhood consultations had taken place and two representations from local residents in opposition to the application had been received, the details of which were advised to the Committee. Six other residents had signed one of the letters of objection.  There were no objections from the statutory authorities.  The Highways Engineer confirmed that there were no concerns with regard to possible traffic congestion.

 

With regard to a concern raised in relation to the possibility of the proposed underground car park being liable to flooding, it was confirmed that this would be dealt with as part of the building regulations. 

 

ORDERED that the application be Approved, subject to:

 

1.       the conditions detailed in the report.

2.       an additional condition to require revised plans detailing the side elevation of the dormer windows.

 

M/FP/0676/12/P - Erection of 10 no detached dwellings with associated roads and infrastructure at Rosebay Close, Coulby Newham, Middlesbrough for Cecil M Yuill Ltd

 

Full details of the planning application, plan status and planning history was outlined in the report. The report contained a detailed analysis of the applications and analysed relevant policies from the Local Development Framework.

 

Neighbourhood consultations had taken place and one representation from a local resident in opposition to the application had been received, together with two letters of support, the details of which were advised to the Committee. There were no objections from the statutory authorities.

 

ORDERED that the application be Approved, subject to the conditions detailed in the report.

 

M/RES/0677/12/P - Reserved matters application for the erection of 3 no dwellings at Southwood and Fernwood, Coulby Newham, Middlesbrough for Cecil M Yuill Ltd

 

Full details of the planning application, plan status and planning history was outlined in the report. The report contained a detailed analysis of the applications and analysed relevant policies from the Local Development Framework.

 

Neighbourhood consultations had taken place and four  representations from  local residents in opposition to the application had been received, the details of which were advised to the Committee. There were no objections from the statutory authorities.

 

ORDERED that the application be Approved, subject to the conditions detailed in the report.
 

12/22 PLANNING APPEAL

The Director of Legal and Democratic Services presented a report, the purpose of which was to advise members of the findings of the Inspectorate appointed by the Secretary of State for Environment, Transport and the Regions, with regard to the following appeal:-

 

31 Emerson Avenue, Middlesbrough - (M/FP/0224/12/P) - Appeal allowed.

 

A copy of the decision notice for the appeal was attached to the report for Members’ information.

 

ORDERED that the report and its contents be noted.

12/23 APPLICATIONS APPROVED BY THE HEAD OF PLANNING AND REGENERATION

The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992).
