12/34 MINUTES - PLANNING AND DEVELOPMENT COMMITTEE - 14 DECEMBER 2012

The Minutes of the meeting of the Planning and Development Committee held on 14 December 2012 were submitted and approved as a true record.

12/35 SCHEDULE OF REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

PLANS

 

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1990 and the Head of Development Control reported thereon.

 

SUSPENSION OF COUNCIL PROCEDURE RULE NO. 10 - ORDER OF BUSINESS

 

ORDERED that, in accordance with Council Procedure Rule No. 10, the Committee agreed to vary the order of business .

 

ORDERED that the following applications be determined as shown:

 

M/FP/1127/12/P - Erection of 3 no. dormer bungalows with projecting front and rear 2 storey gables and detached garages, with associated access.

 

The Head of Development advised Members that this application had been identified as requiring a site visit by members of the Planning and Development Committee. Accordingly a site visit had been held on 11 January 2013.

Full details of the planning application, plan status and planning history were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the Local Development Framework.

 

Neighbourhood consultations had taken place and two representations from local residents in opposition to the application had been received, the details of which were advised to the Committee. There were no objections from the statutory authorities.

The applicant was present at the meeting and elected to address the Committee. Councillor C Hobson, Ward Councillor, addressed the Committee and spoke in opposition to the application. Two objectors present at the meeting elected to address the Committee and spoke in opposition to the application.

 

ORDERED that the application be Approved subject to the following conditions:

1. the conditions detailed in the report for the reasons set out in the report.


2. two additional conditions as follows:

  •  the development hereby approved shall only be served by a biomass type of foul sewage/water disposal system and not by any other form of foul water provision.  The details of such a system and specific location only to the north west of plot 3 shall be submitted to and approved in writing by the local planning authority and only those details as agreed shall be implemented as part of the development hereby approved.

Reason: To ensure a satisfactory form of development. 

  • the proposed driveway shall be the subject of a site investigation report and the constructional details of the driveway in order to deal with the outcome of the site investigation shall be submitted to and approved in writing by the local planning authority and such details shall be implemented wholly in accordance with the requirements of condition 13.

Reason: To ensure a satisfactory form of development.

 

M/FP/1071/12/P - Conversion of existing public house to 15 no self-contained apartments with external alterations and associated car parking for C G R Portfolio Limited.

The Head of Development advised Members that this application had been identified as requiring a site visit by members of the Planning and Development Committee. Accordingly a site visit had been held on 11 January 2013.

Full details of the planning application, plan status and planning history were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the Local Development Framework.

The applicant was in attendance and elected to address the Committee. It was reiterated that the building was a focal point in the community and there was no intention to alter the exterior of the building.
 

ORDERED that the application be Approved subject to the following conditions:

 

1. the conditions detailed in the report for the reasons set out in the report.


2. plus additional conditions as follows:

  •  a plan showing the location of temporary car parking to accommodate operatives and construction vehicles during the development of the site and measures to protect any existing footpaths and verges shall be submitted to and approved in writing by the local planning authority and implemented upon commencement of construction and thereafter such parking is to be removed on completion of works.

 Reason: In the interests of amenity and highway safety.

  • A plan showing the surface water drainage that has been designed to prevent this water from flowing onto the highway to the detriment of all highway users must be submitted to and approved in writing by the local planning authority.

Reason: In the interests of amenity and highway safety.

  • Before the construction of the buildings hereby approved commences, a scheme for a Sustainable Drainage System (SuDS) which shall sustainably drain surface water, minimise pollution and manage the impact on water quality, shall be submitted to and approved in writing by the local planning authority and thereafter to be fully implemented in line with the agreed programme of works to the satisfaction of the local planning authority.

Reason: In the interests of a sustainable development.

  • The scheme shall incorporate the Secure by Design provisions as set out in the applicant's email of 10 January 2013.

Reason: To ensure the development is consistent with Secure by Design principles.

 

 M/FP/1062/12/P - Formation of single platform rail halt, including waiting shelter, access ramp, lighting and CCTV with connecting footpath and vehicle access road for Mr C Cowley.

 

The Head of Development advised Members that this application had been identified as requiring a site visit by members of the Planning and Development Committee. Accordingly a site visit had been held on 11 January 2013.

Neighbourhood consultations had taken place and one representation from a local resident in opposition to the application had been received, the details of which were advised to the Committee. There were no objections from the statutory authorities.

The applicant was in attendance and elected to address the Committee. It was highlighted that the rail halt had been a long-term aspiration of the town and would assist in the regeneration of the area.

 

ORDERED that the application be Approved subject to the conditions included in the report for the reasons set out in the report.

12/36 PLANNING APPEAL

The Director of Legal and Democratic Services presented a report, the purpose of which was to advise members of the findings of the Inspectorate appointed by the Secretary of State for Environment, Transport and the Regions, with regard to the following appeal:-

 

70a Eastbourne Road, Middlesbrough (M/FP/0418/12/P) - Appeal allowed.

 

A copy of the decision notice for the appeal was attached to the report for Members' information.

 

ORDERED that the report and its contents be noted.

12/37 APPLICATIONS APPROVED BY THE HEAD OF PLANNING AND REGENERATION

The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992).

 

Further to discussion regarding Members' concerns in relation to the number of applications for larger scale developments and hot food takeaways that had been determined via delegated authority, the Head of Development confirmed that he would bring such applications to Committee in future.

Site Visits

 

Discussion took place regarding Members speaking and taking decisions on planning applications at Committee when they had not attended site visits.   The comments made were noted by the Chair.

Retirement

 

The Chair reported that two long-serving Planning Officers, Tony Hargreaves and Richard Sales, were leaving the Local Authority.  On behalf of the Committee, the Chair commended the two Officers for their commitment and service and wished them both well for the future.
