13/31 MINUTES - PLANNING & DEVELOPMENT COMMITTEE - 16 DECEMBER 2013

The minutes of the Planning and Development Committee held on 16 December 2013 were taken as read and approved as a true record.

13/32 SCHEDULE OF REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1990 and the Head of Development reported thereon.

 

SUSPENSION OF COUNCIL PROCEDURE RULE NO 10 - ORDER OF BUSINESS

 

ORDERED that, in accordance with Council Procedure Rule No 10, the Committee agreed to vary the order of business. 

 

ORDERED that the following applications be determined as shown:

 

M/FP/0977/13/P - Erection of 153 no dwellings with associated access, open space and landscaping at Clairville Road, Middlesbrough for Mr P Arkle.

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee.  Accordingly a site visit had been held prior to the meeting.

 

Full details of the planning application, plan status and relevant planning history were outlined in the report.  The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and two petitions had been received, one paper and one electronic, objecting to the application.  One objection was also received from the Lead Petitioner. 

 

The applicant addressed the Committee and spoke in support of the application.  Two objectors elected to address the Committee in opposition to the scheme. 

 

In response to a query regarding the access, the Highways Engineer confirmed that the access road was in the correct place and there were no concerns with regard to road safety.

 

ORDERED that the application be Approved on Condition subject to the conditions detailed in the report and amended conditions as follows:

Reason: To ensure a satisfactory form of development and for the avoidance of doubt.

 

Condition 3 would now read:

 

The construction of the approved dwellings shall not commence until samples of the materials to be used in the construction of all the external surfaces within the development phase have been submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details.

Reason: To ensure the use of satisfactory materials.

 

Condition 16 would now read:

 

The construction of the approved dwellings shall not commence until the remediation scheme detailed within the submitted Site Investigation Report (Geoenvironmental Appraisal Sirius Environmental Report Ref: C5308A) is implemented on site. Validation of the remediated site in the form of a detailed completion statement confirming that works set out were completed and that the site is suitable for its intended use shall be submitted to and approved in writing by the Local Planning Authority.

M/FP/1018/13/P - Change of use from dwelling (C3) to 6 no bed house in Multiple Occupation at 107 Cambridge Road, Middlesbrough for Golden Lane Housing Ltd.

Neighbourhood consultations had taken place and seven letters objecting to the proposal and a petition objecting to the application had been received.
 

The agent elected to address the Committee in support of the application.
 

An objector elected to address the Committee in objection to the application.
 

The Head of Development confirmed that the change of use did not require planning permission and was in fact a permitted change of use in accordance with Town and Country (Use Classes) order.
 

ORDERED that the application was Permitted Development.

 

M/FP/0919/13/P - Single storey extension to rear, 2 no pitched roof dormers to rear and 2 no pitched roof dormers to front at 26a The Avenue, Nunthorpe, Middlesbrough for Mr Morris.

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held prior to the meeting.

Neighbourhood consultations had taken place and three objections had been received, including one from the Community Council and one from the Parish Council, details of which were included in the report.

 

An objector elected to address the Committee in objection to the application.

 

ORDERED that the application be Approved on Condition subject to the conditions detailed in the report.

 

M/FP/0920/13/P - Creation of landscaped college 'heartspace' including use of land for leisure related activities (D2), including MUGA pitch, fencing, lighting and associated works on land between Windward Way and Dock Street, Middlehaven, Middlesbrough for Mrs Z Lewis.

 

AND

 

M/FP/0921/13/P - Erection of three storey educational building (D1) with ground floor cafe (A3), landscaping/boundary treatment, access and associated works on land between Windward Way and Dock Street, Middlehaven, Middlesbrough for Mrs Z Lewis.

The reports contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Following the standard notification exercise, no representations were submitted from any local resident or neighbouring property.

 

Councillor McPartland, a Ward Councillor for Middlehaven Ward, was present at the meeting and elected to address the Committee in support of the application.

 

ORDERED that both applications be Approved on Condition subject to the conditions detailed in the reports.

 

M/FP/1028/13/P - Conversion of upper six floors to form student accommodation including 230 no self-contained flats with communal facilities (including lounge, gymnasium, laundry, cycle storage and refuse areas) with associated external works at Rede House, Corporation Road, Middlesbrough, for Fortis Developments Limited.

 

Full details of the outline planning application, plan status and relevant planning history were outlined in the report.  The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and one objection had been received, the details of which were included in the report.

 

Concerns had been raised by the Highways Department regarding the low level of parking and that this type of accommodation could be open to non-student occupants. The agent had confirmed its use by students only and that it was proposed to be, in the main, a car free development. This would be ensured by the tenancy agreement which would specify the situation and could be enforced by the Developer.

 

ORDERED that the application be Approved on Condition subject to the conditions detailed in the report.

 

M/FP/0958/13/P - Two storey extension at side, single storey extension at rear at 4 Glaisdale Avenue, Middlesbrough for Mr M Hussain.

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held prior to the meeting.

Neighbourhood consultations had taken place and no objections had been received.

 

The Applicant had been informed by the Planning Officer that generally a setback of 1 metre was required at first floor level for any two-storey extensions at the side of dwellings as specified in the Middlesbrough Urban Design Supplementary Planning Document adopted in 2013. 

 

ORDERED that the application be Refused for the reasons set out in the report.

M/FP/1027/13/P - Change of use to hand car wash (sui generis) with canopy and staff cabin area at the Car Park, Parkway Centre, Coulby Newham, Middlesbrough for Ms S Davis.

Neighbourhood consultations had taken place and six objections had been received including an objection from the Community Council and an objection from the Ward Councillor. Details of the objections were summarised in the report.

 

The Head of Development explained that the proposal initially was to locate the car wash to the south western boundary of the car park in close proximity to the residential properties of Harvington Chase. However, following the responses from residents, the Applicant agreed to move the location of the proposed car wash to the present location at the northern end of the car park, to remove any potential harm.

 

ORDERED that the application be Approved on Condition subject to the conditions detailed in the report.

13/33 APPLICATIONS APPROVED BY THE HEAD OF PLANNING AND REGENERATION


The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992). 

 

In response to a query regarding approval for the installation of external wall insulation to 42 Linden Grove, Middlesbrough, which was located in a conservation area, the Head of Development confirmed that the application was to install the insulation to the rear and side, (east and north facing) walls only. 

13/34 ANY OTHER BUSINESS


The Head of Development tabled details of two planning applications requiring immediate consideration as follows:
 

M/FP/1107/13/P - Use of land to form 326 no space car park with associated works (barrier systems, CCTV and lighting) at James Cook University Hospital, Marton Road, Middlesbrough for Mr I Roberts.

 

Full details of the outline planning application, plan status and relevant planning history were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and no objections had been received.

 

The application was linked to application M/GRG/0899/13/P (for residential development and access road and hospital car park on the Prissick land). The planning permission for the Oncology building (M/FP/503/09/P) required the Hospital Trust to provide a long-term solution to the car parking problems within the hospital site.

 

A Tree Preservation Order covered the site and an aboricultural report supported the application and included an analysis of tree cover in and around the proposed development area.

 

ORDERED that the application be Approved on Condition subject to the conditions detailed in the report.
 

M/FP/1148/13/P - Hybrid application including full plans application for 'Urban Park' including remediation of land, new access road and public realm works with associated landscaping/boundary treatment, and outline permission for mixed use development ('Urban pioneers') comprising residential (C3), business (B1), shop (A1), financial and professional services (A2), restaurant/cafe (A3), drinking establishment (A4) and non-residential institutions (D1) on land at Lower East Street/Durham Street/Gray Street/Vulcan Street, Middlehaven, Middlesbrough for Martin Boys.

 

A site visit had been held prior to the meeting. Full details of the outline planning application, plan status and relevant planning history were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and no objections had been received. Responses from statutory consultees were still awaited.

 

The proposed development was subdivided into three main strands: the Urban Park, the Urban Pioneers and the remediation and access road.

 

ORDERED that the application be Endorsed in Principle, and the Chair and Vice Chair of the Committee authorised to agree the conditions, which would be drawn up in due course following receipt of responses from all statutory consultees.
