14/1 MINUTES - PLANNING AND DEVELOPMENT COMMITTEE - 2 MAY 2014

The minutes of the Planning and Development Committee held on 2 May 2014 were taken as read and approved as a true record.

14/2 SCHEDULE OF REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1980 and the Head of Development reported thereon.

SUSPENSION OF COUNCIL PROCEDURE RULE NO 10 - ORDER OF BUSINESS

ORDERED that, in accordance with Council Procedure Rule No 10, the Committee agreed to vary the order of business.

ORDERED that the following applications be determined as shown:

 

M/FP/0275/14/P - Erection of detached annexe and detached double garage at 97 The Grove, Marton, Middlesbrough for Mr Din 

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework. The report also outlined the requirements of The Grove Conservation Area Management Plan.

 

Neighbourhood consultations had taken place and the occupier of 97b The Grove had offered no objections to the application. The Ward Councillors for Marton and Marton Community Council and the occupier of 98 The Grove had submitted objections to the application, the details of which were contained within the Committee report. There were no objections to the application received from the statutory consultees.

 

Members were shown a copy of computer generated images which showed the existing development and the proposed development which had been produced by the Applicant.    
 

The Ward Councillor for Marton elected to address the Committee in objection to the application. The occupier of 98 The Grove also elected to address the Committee in objection to the application.

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report.

 

M/FP/0372/14/P - Erection of 2 No. semi-detached bungalows at 30 Faverdale Avenue, Acklam, Middlesbrough for Mr M Robinson

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and the occupiers of 19, 20, 21, 26 and 28 Faverdale Avenue and 72 and 74 Hesleden Avenue had submitted objections to the application, the details of which were contained in the report. The Highways Department had indicated that they had concerns regarding the capacity to manoeuvre vehicles at the turning head.   

 

An objector elected to address the Committee in objection to the application.

 

ORDERED that the application be Refused for the reasons contained in the report. 

 

M/RES/0438/14/P - Reserved matters application to approve southern access road at Acklam Hall, Acklam, Middlesbrough for Acklam Hall Ltd and Taylor Wimpey (North Yorkshire) Ltd 

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and following distribution of the Committee papers objections had been received from the occupiers of 23 Rochester Road, 22 Fountains Drive, 62 Ingram Road, 3 Buttermere Avenue, the details of which were circulated to Members of the Committee in a Supplementary Committee Note. No adverse comments were received from the Statutory consultees however English Heritage had indicated that the road should be detailed in a way that avoided a standard tarmac road/pavement approach and that a condition should be attached to the planning permission with regard to the proposed construction and materials of the road.    

 

A representative from Acklam Hall Ltd spoke in support of the application. Councillor Lowes also spoke in support of the application.


ORDERED that the application be Approved on Condition subject to the conditions contained in the report.

 

M/FP/0210/14/P - Erection of public house/restaurant with ancillary residential use at first floor and associated external areas, boundary treatment/landscaping and car parking/access at land at Grey Towers Farm, Nunthorpe, Middlesbrough for Mitchells & Butler Leisure Retail Ltd

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and the occupiers of 24, 31, 33 and 34 Collingham Drive and 14 Crookersgill Close, 11 Debrus Park, 62 Grey Towers Drive, 32 Mallowdale and 1 The Resolution had submitted objections to the application. There were no objections received from the Statutory consultees.

 

The Head of Development advised Members that the nearest existing residential properties to the proposed development were located approximately 40m from the site. It was clarified that in terms of the covenant that existed in relation to The Grey Towers Site, the Council's Legal Officer had confirmed that covenants were not a material planning consideration. It was highlighted that the condition detailed at No. 8 in the report had also been removed.

 

A representative on behalf of the applicant spoke in support of the application.  

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report (with the deletion of condition 8).

 

M/FP/0174/14/P - Residential development comprising 164 No. dwellings with associated access, landscaping/boundary treatment and car parking at land adjacent to MTLC, Cargo Fleet Lane, Middlesbrough for Gleeson Developments Ltd

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and no objections to the application had been received from local residents or the Statutory consultees. It was highlighted that the objection received from Sport England was not classified as a response from a statutory consultee as the playing fields had not been used for this facility for a period of over five years.

 

The Head of Development advised that the condition contained at no. 7 in the report had been removed and condition no. 9 had been revised.     

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report (with the deletion of condition no. 7 and the revision of condition no. 9).

 

M/FP/0374/14/P - Change of use from tattoo studio (sui generis) to cafe (A3) at 23 Shelton Court, Thorntree, Middlesbrough for Ms S Ayre

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.
 

Neighbourhood consultations had taken place and a 36 signature petition and four individual representations had been received in objection to the application together with one representation in support of the application, the details of which were included in the report. There were no objections received from the Statutory consultees.

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report.

14/3 APPLICATIONS APPROVED BY THE HEAD OF PLANNING AND REGENERATION

The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992).
