14/5 MINUTES - PLANNING AND DEVELOPMENT COMMITTEE - 23 MAY 2014

The minutes of the Planning and Development Committee held on 23 May 2014 were taken as read and approved as a true record.

14/6 SCHEDULE OF THE REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1980 and the Head of Development reported thereon.

 

SUSPENSION OF COUNCIL PROCEDURES RULE NO 10 - ORDER OF BUSINESS

 

ORDERED that, in accordance with Council Procedure Rule No 10, the Committee agreed to vary the order of business.

 

ORDERED that the following applications be determined as shown.

 

M/GRG/0364/14/P - Erection of single storey extension to provide 2 no classrooms and office space at Newham Bridge Primary School, Cayton Drive, Acklam for Mrs B Hewitt-Best

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and eight objections had been received, the details of which were contained in the submitted report. Acklam Community Council had also submitted an objection to the application. It was highlighted that the majority of objections related to the likelihood of additional traffic and concerns in relation to highway safety. There were no objections to the application received from the statutory consultees.

 

The Ward Councillor for Acklam elected to address the Committee and spoke in support of the application. The applicant also spoke in support of the application.

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report.
 

M/GRG/0491/14/P - Single storey classroom extensions at Lingfield Primary School, Buxton Avenue, Marton-In-Cleveland, Middlesbrough for Mr P Thackstone

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and four objections had been received, the details of which were contained in the submitted report. It was highlighted that the majority of objections related to parking and traffic outside of the school. There were no objections to the application received from the statutory consultees.

 

The applicant elected to address the Committee and spoke in support of the application.

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report.

 

M/FP/0246/14/P - Two storey extension at side/rear and single storey extension at rear (demolition of existing kitchen at rear) at 101 Park Road South, Middlesbrough for Mr S Hussain

 

Full details of the planning application and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

The Head of Development confirmed that the Albert Park and Linthorpe Road Conservation Area was designated in April 2013.

 

Neighbourhood consultations had taken place and no objections were received from residents. There were no objections received from the statutory consultees. The applicant’s representative elected to address the Committee and spoke in support of the application.

 

ORDERED that the application be Refused for the reasons contained in the report.

 

M/FP/0416/14/P - Change of use from retail (A1) to hot food takeaway (A5) with ducting to side at 165 Crescent Road, Linthorpe, Middlesbrough for Mr M Wajid

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and three individual representations and an eleven signature petition in opposition to the application had been received, the details of which were contained in the submitted report.

 

Community Protection required standard conditions in relation to the ventilation system as well as controls on opening hours. There were no objections to the application received from the other statutory consultees.

 

An objector elected to address the Committee in relation to the application.

 

ORDERED that the application be Refused for the reasons contained in the report.

 

M/FP/0444/14/P - Erection of 1 no dwelling with detached double garage (retrospective amendment to previously approved plans for M/FP/0062/13/P) at 68b Southwood, Coulby Newham, Middlesbrough for Mr and Mrs D Brown

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

The application was partially retrospective following Planning Enforcement action that identified that the property was not being built in accordance with the approved plans scheme (M/FP/0062/13/P). The building erected was of the same footprint and dimensions as the previously approved dwelling. However, the location of the dwelling had been altered, and was now approximately one metre further north and approximately half a metre further forward. The proposal also included alterations and additions to window openings.

 

Neighbourhood consultations had taken place and three letters of objection had been received from the occupiers of number 1 Fernwood and numbers 86 and 87 Southwood. The details of the representations were contained in the submitted report. There were no objections received from the statutory consultees.

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report.

M/AMD/0649/13/P - Non-material amendment to M/FP/0649/13/P to reposition the house location from the approved plans at land north of 147 Eagle Park, Marton, Middlesbrough for Mr D O’Brien

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

The application to amend the location of the previously approved dwelling had been received following a report that the dwelling was not being constructed in accordance with approved plans.

 

Neighbourhood consultations had taken place and one objection had been received. There were no objections to the application received from the other statutory consultees.

 

The applicant was present and elected to address the Committee in support of the application.  An objector elected to address the Committee in relation to the application.

 

ORDERED that the application be Approved on Condition subject to the conditions in the report.

 

M/FP/0457/14/P - Conversion of existing garage and extensions to provide 1 no dwelling with associated access and boundary treatments at 4 Hall Drive, Middlesbrough for Mr A Ghafoor

 

The Head of Development advised Members that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

14/7 PLANNING APPEAL

The Assistant Director Organisation and Governance presented a report, the purpose of which was to advise Members of the findings of the Inspector appointed by the Secretary of State for Environment, Transport and the Regions, with regard to the following planning appeals:-

 

1. Site at 89 Rockcliffe Road, Middlesbrough - APP/W0734/D/14/2216801 
- Appeal allowed.

 

2. Site at 41 Chalford Oaks, Middlesbrough - APP/W0734/D/14/2217382
- Appeal allowed.

 

Copies of the decision notices in respect of both appeals were attached to the report for Members' information.

 

ORDERED that the report and its contents be noted.

14/8 APPLICATIONS APPROVED BY HEAD OF PLANNING AND REGENERATION

The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992).

14/9 ANY OTHER URGENT ITEMS WHICH IN THE OPINION OF THE CHAIR, MAY BE CONSIDERED.


The Head of Development referred Members to application M/FP/1258/12/P for 125 bed hotel at Cook House and Endeavour House, 93-127 Albert Road, Middlesbrough, for Mr R Williams.  As requested, the architect had submitted three colour schemes for the new hotel which were displayed on the screen for Members' consideration.   The preferred option would be worked up in detail by the architect and re-submitted at a later date to the Planning and Development Committee.

 

ORDERED that design number one was the preferred option.
