14/10 MINUTES - PLANNING AND DEVELOPMENT COMMITTEE - 20 JUNE 2014

The minutes of the Planning and Development Committee held on 20 June 2014 were taken as read and approved as a true record.

14/11 SCHEDULE OF THE REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1980 and the Head of Development reported thereon.

SUSPENSION OF COUNCIL PROCEDURE RULE NO 10 - ORDER OF BUSINESS

ORDERED
that, in accordance with Council Procedure Rule No 10, the Committee agreed to vary the order of business.

ORDERED that the following applications be determined as shown:

 

M/FP/0571/14/P - Erection of 1 no dwelling house at 9 Oakfield Gardens, Ormesby, Middlesbrough for Mr D Richardson

 

The Head of Development advised that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and objections to the application had been received from the occupiers of 1,2, 3,4,5,6,7,8,10,11,12 Oakfield Gardens together with an objection to the application that did not contain an address, the details of which were contained in the report. There were no objections received from the statutory consultees however the Waste Policy, Environment Agency and Highways department had all suggested issues which would need to be dealt with by way of conditions if the application was to be approved.

 

A representative on behalf of the applicant elected to address the Committee in support of the application. The six objectors present at the meeting, elected a representative to address the Committee in objection to the application.

 

ORDERED that the application be Refused for the reasons set out in the report.

 

M/FP/0529/14/P - Erection of 5 no dwellings with associated access and boundary treatment at Westcote Cottage, Hollins Lane, Middlesbrough for Mr C Doocey

 

The Head of Development reminded Members that the Planning and Development Committee had visited the application site on 2 May 2014. The previous planning application (M/FP/0088/14/P) was refused at the Planning and Development Committee on 2 May 2014, as it was considered that the proposed layout of the site would result in a direct impact on the flats within the Hanover Housing Association development to the south of the application site. The architect had subsequently redesigned the scheme to take account of the comments of objectors in relation to the first application and the reasons for refusal of that application by the Planning and Development Committee.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.
 

Neighbourhood consultations had taken place and no objections to the application had been received. The Planning Officer had also discussed the application with the Estate Manager for Hanover Housing Association and was advised that residents had offered no objections to the application.   

 

The applicant's architect elected to address the Committee in support of the application. The Highways Officer addressed the Committee to outline the reasons for the Highways' Department's recommendation for refusal of the application.

 

ORDERED that the application be Approved on Condition subject to the conditions contained in the report. 

14/12 PLANNING APPEAL

The Assistant Director Organisation and Governance submitted a report to advise Members of the findings of the Inspector appointed by the Secretary of State for Environment, Transport and the Regions, with regard to the following planning appeal:-

 

Appeal Ref: APP/W0734/A14/2216389 - Land at Ford Close Riding School, Brass Castle Lane, Nunthorpe, Middlesbrough, TS8 9EE (M/OUT/1131/13/P) - Appeal Dismissed

 

The Head of Development advised that although the appeal had been dismissed, the Inspector had awarded costs to the applicant - limited to a proportion of the time spent on making the appeal, as in his view, the Council's appeal statement did not contain enough substantive reasoning in respect of the technical engineering reasons for refusal.

 

Copies of the decision notices in respect of the appeal and costs decision were attached to the report for Members' information.

 

ORDERED that the report and its contents be noted.     

14/13 APPLICATIONS APPROVED BY HEAD OF PLANNING AND REGENERATION

The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992).

14/14 ANY OTHER BUSINESS

M/FP/1258/12/P - Change of use from class B1 (business) to class C1 (hotel) to form 125 bed hotel, including changes to external facade & shop fronts at Cook House and Endeavour House, 93-127 Albert Road, Middlesbrough, for Mr R Williams

 

At the previous meeting of the Planning and Development Committee, held on 20 June 2014, the architect had submitted three colour schemes for the new hotel for Members' consideration. Members had been advised that the preferred option would be worked up in detail by the architect and re-submitted to Committee at a later date.

 

In accordance with the above the architect had submitted the final choice of colour scheme for the fascia of the new hotel for Members' consideration.

 

ORDERED that the preferred choice of colour scheme for the fascia of the new hotel be approved.

 

FORMER DOUGLAS HOUSE SITE MARTON ROAD MIDDLESBROUGH TS4 2BH

 

The Head of Development advised that an organisation called Fair Homes would be submitting an application in respect of the former Douglas House Site on Marton Road for Student accommodation comprising a 5 storey block of 182 No apartments with associated car parking and landscaping.

 

It was anticipated that the application would be received by the Planning Service forthwith and the application be reported to the Planning & Development Committee on 15th August 2014. This may not be sufficient time to receive all the responses from the consultees and Committee may, therefore, ask for the Chairman and Vice Chairman’s approval to the scheme once all consultation responses had been received.

 

ORDERED that the Head of Development Control bring this application to Committee as soon as practicable.
