14/15 MINUTES - PLANNING AND DEVELOPMENT COMMITTEE - 18 JULY 2014

The minutes of the Planning and Development Committee held on 18 July 2014 were taken as read and approved as a true record.

14/16 SCHEDULE OF THE REMAINING PLANNING APPLICATIONS TO BE CONSIDERED BY COMMITTEE

The Head of Development submitted plans deposited as applications to develop land under the Town and Country Planning Act 1980 and the Head of Development reported thereon.

 

SUSPENSION OF COUNCIL PROCEDURE RULE NO 10 - ORDER OF BUSINESS

 

ORDERED that, in accordance with Council Procedure Rule No 10, the Committee agreed to vary the order of business.

 

ORDERED that the following applications be determined as shown:

 

M/OUT/0554/14/P - Outline application for erection of 5 no detached dwelling houses at Land at De Brus Park, Marton, Middlesbrough, for Middlesbrough Council

 

The Head of Development advised that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and objections to the application had been received from the occupiers of 6, 7, 10, 11, 16 De Brus Park. There were no objections received from the statutory consultees and it was highlighted that English Heritage did not consider it was necessary for the application to be notified to them.

 

A representative on behalf of an objector elected to address the Committee in objection to the application.

 

ORDERED that the application be Approved on Condition subject to the conditions detailed in the report.

 

Councillor P Khan, who had previously declared a prejudicial interest, left the meeting during consideration of the next item.

 

M/FP/0766/14/P - Student accommodation comprising a 5 storey block of 182 No apartments with associated car parking and landscaping at the Former Douglas House Site, Marton Road, Middlesbrough for Mr J Harley.

 

Members of the Planning and Development Committee had visited the site on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and no objections had been received. There were no objections received from the statutory consultees. The applicant's agent elected to address the Committee in support of the application.

 

ORDERED that the application be Approved on Condition, subject to condition 1, the addition of a revised plan date (site plan), the removal of conditions 4 and 9 (site remediation and waste storage had previously been agreed) and two additional conditions as follows:

 

The development permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) dated 27 January 2005, report no: 04T692/R001 by Billinghurst George and Partners and the following mitigation measures detailed within the FRA:

 

1.  Finished floor levels are set no lower than 5.2m above Ordnance Datum (AOD).

2.  Mitigation measures identified in section 7.4 of the FRA (waterproof tanking in the basement and the installation of flood gates on the entrance).

 

The mitigation measures shall be fully implemented prior to occupation and subsequently in accordance with the timing/phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the local planning authority.

 

Reason: To reduce the risk of flooding to the proposed development and future occupants.

 

The development hereby permitted shall not be commenced until such time as a flood evacuation plan has been submitted to, and approved in writing by, the local planning authority. 

 

The scheme shall be fully implemented and subsequently maintained, in accordance with the timing/phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the local planning authority.

 

Reason: To reduce the risk of flooding to the proposed development and future users.

 

Councillor P Khan re-joined the meeting.

 

M/FP/0722/14/P - Change of use from retail (A1) to hot food takeway (A5) with ducting at rear at 259 Acklam Road, Middlesbrough for Mr A Razzaq

 

Members of the Planning and Development Committee had visited the site on the morning prior to the meeting.

Neighbourhood consultations had taken place and three objections had been received. There were no objections received from the statutory consultees.

 

The applicant’s agent elected to address the Committee in support of the application.

 

ORDERED that the application be Approved on Condition subject to the conditions detailed in the report.

 

M/FP/0706/14/P - Demolition of former scout hut and conversion of former school building to create 5 no dwellings at Former School Site, Church Lane, Nunthorpe, Middlesbrough for Mr D McGlynn

 

The Head of Development advised that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and no objections had been received from residents or community groups. However, Councillor B Thompson, Ward Councillor, had informed the Head of Development that no consultation had taken place with Ward Councillors or the Community Council.

 

The applicant addressed the Committee in support of the application.

 

ORDERED that the application be Approved on Condition, subject to an additional condition as follows and the Committee's request that the discharge of the materials condition be carried out in consultation with the Chair/Vice Chair and Ward Councillors.

 

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no garages shall be erected (other than those expressly authorised by this permission).

 

Reason: In order that the local planning authority may safeguard the visual amenities of the area.

 

M/FP/0779/14/P - Conversion of public house to restaurant (A3), including ground floor extensions to sides and rear, external alterations and formation of hot food takeaway (A5) and deletion of previous proposal for in/out access from Marton Road at The White Rose Public House, 283 Marton Road, Middlesbrough for Mr A Mourzzam

 

The Head of Development advised that the above application had been identified as requiring a site visit by Members of the Planning and Development Committee. Accordingly a site visit had been held on the morning prior to the meeting.

 

Full details of the planning application, planning history and the plan status were outlined in the report. The report contained a detailed analysis of the application and analysed relevant policies from the National Planning Policy Framework and the Local Development Framework.

 

Neighbourhood consultations had taken place and two objections had been received. There were no objections received from the statutory consultees. The Environmental Health Officer would suggest conditions to deal with, and ensure, an adequate ventilation system and filters were in place and opening hours were controlled.

 

An objector elected to address the Committee in objection to the application. The applicant and a Ward Councillor from a neighbouring Ward spoke in support of the application.

ORDERED that the application be Approved on Condition, subject to a revision to Conditions 2 and 5 as follows:

 

The development hereby approved shall be carried out in complete accordance with the plans and specifications received on 31 July 2014 and 15 August 2014 and shall relate to no other plans.

 

Reason: To ensure a satisfactory form of development and for the avoidance of doubt.

 

The premises shall only operate between the hours of 12 midday - 12.00 pm midnight daily and the take-away facility between 4.00 pm - 11.30 pm.

 

Reason: In the interests of the amenity of the area.

 

M/FP/0651/14/P - Erection of 18 no. bed three storey student accommodation block at 3 Park Road South, Middlesbrough for Mr C Atha

The Head of Development had been advised by the applicant that a Noise Assessment would be undertaken and submitted.

 

ORDERED that the application be DEFERRED.

14/17 APPLICATIONS APPROVED BY THE HEAD OF PLANNING AND REGENERATION

The Head of Development submitted details of planning applications which had been approved to date in accordance with the delegated authority granted to him at Minute 187 (29 September 1992).
